Terms & Conditions – Conecsy CPaaS Platform

These Terms & Conditions govern access to and use of Conecsy’s CPaaSplatform, APIs, and communication services.

1. Introduction & Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally bindingagreement between you (“Customer”, “User”, or “you”) andConecsy Technology Private Limited (“Conecsy”, “we”,“our”, or “us”).

By accessing, registering for, or using any Conecsy website,application, dashboard, API, or communication service, you acknowledgethat you have read, understood, and agreed to be bound by these Terms.

If you do not agree to these Terms, you must immediately discontinue use of the services. These Terms apply to all users accessing Conecsy services through web platforms, dashboards, APIs, or integrations.

2. Definitions

  • “Services” means Conecsy’s CPaaS offerings including SMS, Voice, Email, WhatsApp, and RCS.
  • “Customer Data” means data submitted or transmitted by the Customer through the platform.
  • “End User” means the recipient of communications sent using Conecsy services.
  • “Applicable Laws” means all local, national, and international laws governing electronic communications.

3. Scope of Services

Conecsy provides a cloud-based Communications Platform as a Service(CPaaS) enabling businesses to integrate and manage omnichannelcommunications.

  • Application-to-Person (A2P) SMS messaging
  • Voice calls, IVR, missed call, and OTP services
  • Transactional and bulk Email messaging
  • WhatsApp Business messaging APIs
  • Rich Communication Services (RCS)

Conecsy does not originate, review, or approve Customer message content and acts solely as a technology enabler.

4. Account Registration & Security

To access certain services, you may be required to create an account. You agree to provide accurate, current, and complete information.

  • You are responsible for safeguarding login credentials
  • You must notify Conecsy immediately of unauthorized access
  • Accounts may not be shared without written authorization

5. Regulatory Compliance & Customer Responsibilities

Customers are solely responsible for ensuring compliance with all Applicable Laws, including but not limited to:

  • TRAI, DLT, and telecom regulations
  • IT Act, 2000 and data protection laws
  • GDPR or other international privacy frameworks
  • WhatsApp Business and carrier policies

Customers must obtain valid opt-in consent from End Users before sending any communication.

6. Prohibited Use

You agree not to use Conecsy services for:

  • Spam, unsolicited, or deceptive communications
  • Fraud, phishing, or impersonation
  • Adult, hateful, or unlawful content
  • Violation of intellectual property or privacy rights

Conecsy reserves the right to suspend services immediately upon detection of misuse.

7. Data Protection & Privacy

Conecsy processes Customer Data solely for the purpose of providing the services. Customers remain the data controllers, while Conecsy acts as a data processor.

8. Pricing, Billing & Taxes

Service charges are usage-based unless otherwise agreed in writing. Customers agree to pay all applicable fees as per invoicing terms.

  • All fees are exclusive of GST or other taxes
  • Late payments may result in service suspension
  • Credits are non-refundable unless explicitly stated

9. Service Availability & Performance

Conecsy aims to maintain high availability but does not guarantee uninterrupted or error-free operation.

Service disruptions may occur due to carrier outages, maintenance, regulatory actions, or force majeure events.

10. Intellectual Property Rights

All Conecsy software, APIs, documentation, dashboards, and branding are proprietary and protected by intellectual property laws.

Customers are granted a limited, non-transferable right to use the services during the subscription period.

11. Limitation of Liability

To the maximum extent permitted by law, Conecsy shall not be liable for indirect, incidental, or consequential damages.

Conecsy’s total liability shall not exceed the fees paid by the Customer in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Conecsy from any claims, damages, or penalties arising from your use of the services or violation of Applicable Laws.

13. Termination & Suspension

Conecsy may suspend or terminate services immediately for:

  • Violation of these Terms
  • Regulatory non-compliance
  • Non-payment of dues

14. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts located in India shall have exclusive jurisdiction, subject to applicable statutory provisions.

15. Amendments

Conecsy may revise these Terms from time to time. Continued use of services constitutes acceptance of updated Terms.
